Dispute resolution services
We are specialists in resolving contract disputes and are regularly appointed in arbitration and adjudication proceedings.
We have extensive experience with contentious construction & engineering claims.
Whether you are defending or claiming, we can provide concise advice and strategy on how to best deal with the matter. See below for more information on the types of Alternative Dispute Resolutions (ADR) we can provide.
Negotiation
The first stage of handling a dispute is Negotiation. We can assist you through an informal, private or facilitated negotiation process with the aim to agree to settle the dispute. This can be done at a high level or in detail and the parties agree to be bound by this settlement.
Conciliation
Similar to Mediation, Conciliation is the next step that can be taken as an Alternative Dispute Resolution. It brings in a neutral third party to look to bring about a amicable solution to the problem. Due to its informal structure it tends to be a quicker way of dealing with the dispute with the conciliator able to put non-binding proposals to each party involved.
Mediation
Just like Conciliation, Mediation brings a third party into the proceedings to look to for a way to bring both parties together to find a solution that benefits everyone involved. Parties are able to terminate the mediation proceedings at any time after the first meeting and no decision can be imposed on either of the parties involved. The confidentiality principle assures that any options the parties discuss will not have consequences beyond the mediation process.
Adjudication
When parties are in dispute about an amount owed for construction work, the claimant can deliver an adjudication application to the Registrar. This formal method of dispute gives the parties an outcome that is enforceable in court.
Arbitration
Arbitration is a private, contractual form of dispute resolution. It allows for disputes to be determined by a third party arbitrator or arbitration panel that has been selected by the parties involved in the dispute. Disputes are resolved on the basis of material facts, documents and relevant principles of law.
